| dc.description | La idea de la constitución como norma suprema y de la legislación como normativa subordinada a aquélla, propia del Estado derecho constitucional, choca en la realidad ?como lo notara Hegel- con la tarea legislativa de los congresos o parlamentos. Guiado por esta hipótesis, el trabajo estudia en sus más diversas ramas la producción legislativa del Congreso Nacional entre 1862 y 1880, proponiendo como conclusión la tesis de una constitución abierta por la existencia de diversos tipos de leyes, que desbordan el cerco dogmático formal del constitucionalismo liberal. | - |
