| dc.description | Resumen: El trabajo analiza la garantía de seguridad jurídica y el principio de legalidad penal en los Decreta de las Cortes de León de 1188, de Alfonso IX, en tanto límites normativos concretos al ejercicio del ius puniendi de la época. Y a partir de allí, concluye que ese revolucionario texto político y jurídico, de la Baja Edad Media española, constituye un antecedente insoslayable –más usualmente desatendido, en la bibliografía científica– en el estudio de la génesis histórica y el origen conceptual de algunos de los principios más relevantes del Derecho Penal moderno. | - |
| dc.description | Abstract: This paper analyzes the guarantees and safeguards of legal certainty and the principle of legality in the Decreta of the Courts of Leon of 1188, during the reign of Alfonso IX, both regulatory limits to the exercise of the ius puniendi of the time. Thereafter, it concludes that this revolutionary political and legal text of the Spanish Lower Middle Ages is an unavoidable precedent –usually neglected in the scientific literature– in relation to the study of the historical genesis and origins of some of the most relevant principles of modern criminal law. | - |
